1. Acceptance of Terms

These Terms of Use govern your access to and use of PhotoAI, including our mobile application, website, AI photo editing features, subscriptions, and related services. By using PhotoAI, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use PhotoAI.

2. The Service

PhotoAI provides AI-powered photo editing and generation tools. Features may include enhancement, expansion, colorization, scratch repair, background removal, object removal, AI filters, aging results, couple portraits, and future baby image generation.

We may modify, suspend, or discontinue features at any time. Some features depend on third-party AI providers and may be unavailable, delayed, or return imperfect results.

3. Subscriptions, Trials, and Purchases

PhotoAI may offer paid subscriptions, free trials, or in-app purchases through Apple App Store. Subscription pricing, duration, trial availability, renewal terms, and cancellation options are shown before purchase and managed by Apple.

• Subscriptions renew automatically unless canceled through your Apple ID settings.
• Free trials, if offered, convert to a paid subscription unless canceled before the trial ends.
• We do not process your payment card directly.
• Refund requests are handled by Apple according to Apple policies.
• Restore Purchase can be used to recover active purchases on supported devices.

4. User Content and Rights

You keep your rights in the photos and images you upload to PhotoAI. You grant us a limited license to process, transmit, store, modify, and display your uploaded content only as needed to provide the feature you request, operate the app, and comply with legal obligations.

You are responsible for ensuring that you have the necessary rights, permissions, and consent to upload, edit, generate, save, or share any image through PhotoAI.

5. Acceptable Use

You agree not to use PhotoAI to:

• Violate any law, regulation, platform rule, or third-party right.
• Upload content you do not have permission to use.
• Create deceptive, harmful, defamatory, harassing, or non-consensual content.
• Impersonate someone or misrepresent generated content as authentic when that would be deceptive.
• Attempt to bypass security, payment, rate limits, or technical restrictions.
• Reverse engineer, scrape, overload, or interfere with the service.

6. AI Results

AI-generated results may be inaccurate, unexpected, low quality, delayed, or unavailable. PhotoAI does not guarantee that a result will look exactly like a reference image or meet your expectations.

You are responsible for reviewing generated results before saving, sharing, publishing, or using them for any purpose. Do not use generated content in a way that violates someone else's rights or creates confusion, harm, or deception.

7. Privacy

Our Privacy Policy explains how we process photos, AI inputs, purchase information, and technical data. Please review it before using PhotoAI.

8. Termination

We may suspend or terminate access to PhotoAI if you violate these Terms, misuse the service, create legal risk, or if continued operation becomes impractical or unlawful.

9. Disclaimer and Limitation of Liability

PhotoAI is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.

To the fullest extent permitted by law, PhotoAI and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities.

10. Changes to Terms

We may update these Terms from time to time. If changes are material, we will update the effective date and provide notice where required.
