Privacy Policy

1. Overview

This Privacy Policy explains how PhotoAI collects, uses, processes, and protects information when you use our mobile application, website, and related services. PhotoAI provides AI-powered photo editing features such as enhancement, restoration, background removal, object removal, AI filters, aging effects, couple portraits, and future baby generation.

By using PhotoAI, you agree to the processing described in this Privacy Policy. If you do not agree, please do not use the app.

2. Information We Process

Depending on how you use PhotoAI, we may process the following categories of information:

  • Photos and images: photos you select, capture, upload, edit, or generate through the app.
  • Face data: selected photos may contain a person's face and visual facial characteristics such as face shape, eyes, nose, mouth, skin tone, hair, and apparent age. PhotoAI processes these visual characteristics only when needed to perform the AI feature you request.
  • AI prompts and feature settings: selected tools, style choices, mask images, skin tone selections, gender selections, and similar inputs needed to generate a result.
  • Purchase information: subscription status, product identifiers, transaction status, and entitlement information provided through Apple and RevenueCat. We do not receive your full payment card details.
  • Device and technical information: basic diagnostics, app version, device type, and request metadata needed to operate and secure the service.
  • Support information: information you send us if you contact support or provide feedback.

3. Face Data Collection and Use

What face data we collect: PhotoAI processes only the photos that you intentionally select or capture for an AI feature. Those photos may include a face and visual facial characteristics such as face shape, eyes, nose, mouth, skin tone, hair, and apparent age. PhotoAI does not scan your photo library, create a biometric face template, calculate face geometry for identification, or collect Face ID data.

How face data is collected: a photo is collected only after you choose it from the photo library or camera and give in-app permission to send the selected photo to our third-party AI processing services. If you select "Not Now," the photo is not sent and the requested AI feature does not run.

Planned uses: face data is used only to provide the feature selected by the user, including photo enhancement, colorization, restoration, expansion, background or object removal, hairstyle and outfit filters, age-progression portraits, couple portraits, and future-baby images. PhotoAI does not use face data for face recognition, identity verification, authentication, advertising, tracking, user profiling, or training PhotoAI's own AI models.

Sharing: the selected photo and feature settings are transmitted through PhotoAI's Cloudflare infrastructure to Replicate for AI inference. Depending on the selected feature, Replicate processes the request using a model supplied or operated by OpenAI, Google, xAI, Bria, 851 Labs, piddnad, flux-kontext-apps, zylim0702, or another model publisher identified in the service configuration. These providers process the data only to return the result requested by the user and are required to protect it under their applicable terms and privacy commitments.

Retention: PhotoAI does not permanently store input photos in its Cloudflare Worker or R2 storage. Input photos are held only long enough to transmit and process the request. For API predictions, Replicate states that input parameters, output values, output files, and logs are removed automatically after one hour by default. Generated result copies stored by PhotoAI in Cloudflare R2 are deleted automatically within 30 days. Images saved to the user's device remain there until the user deletes them.

4. Photos and AI Processing

PhotoAI does not upload every photo in your library. We only process photos you choose to submit for a specific feature. When you select an AI feature, your selected images and related inputs may be uploaded to our backend and third-party AI providers so the requested result can be generated.

Before the first transmission, PhotoAI presents an in-app disclosure that identifies the data being sent, the recipients, the purpose, and the retention periods. The photo is transmitted only after the user selects "Allow & Continue."

You are responsible for making sure you have the right and permission to upload and edit any photo you submit to PhotoAI.

5. How We Use Information

We use information to:

  • Provide, operate, and improve PhotoAI features.
  • Generate AI photo results requested by you.
  • Save, display, download, and share generated results at your direction.
  • Manage subscriptions, purchases, free trials, and restore purchase requests.
  • Prevent abuse, fraud, security incidents, and unauthorized use.
  • Respond to support requests and troubleshoot app issues.
  • Comply with legal obligations and platform requirements.

6. Service Providers and Disclosure

We may share information with service providers that help us operate PhotoAI. These providers process information on our behalf and may include:

  • Cloudflare: receives selected photos through our Worker, provides request routing and security, and stores generated results in R2 for up to 30 days.
  • Replicate: receives selected photos and feature settings and runs the selected AI model. Replicate API prediction data is removed after one hour by default.
  • AI model publishers and operators: depending on the selected feature, this may include OpenAI, Google, xAI, Bria, 851 Labs, piddnad, flux-kontext-apps, zylim0702, or another publisher identified for the selected model.
  • Apple and RevenueCat: process subscription and entitlement information. They do not receive photos from PhotoAI for AI processing.
  • Analytics, diagnostics, and support tools if enabled.

We do not sell your photos. We do not use your photos for advertising tracking. We do not allow third parties to use your submitted photos for their own marketing.

7. Retention

Input photos, including photos containing faces, are not written to PhotoAI's R2 storage. They are held in the Cloudflare request only long enough to be sent to Replicate and processed. Replicate API prediction input parameters, output values, output files, and logs are removed after one hour by default. PhotoAI-generated result copies are retained in Cloudflare R2 for no longer than 30 days and are then automatically deleted.

If you want to request deletion of information associated with your use of PhotoAI, contact us using the contact method below. Some data may need to be retained where required by law, payment records, fraud prevention, or platform obligations.

8. Your Choices and Consent

  • You can deny camera or photo library permissions in iOS settings.
  • You can select "Not Now" in the AI processing disclosure. In that case, no photo is sent.
  • You can choose not to upload a photo to any AI feature.
  • You can delete generated images from your device after saving them.
  • You can manage or cancel subscriptions through your Apple ID settings.
  • You can contact us to request access, correction, or deletion where applicable.

9. Children

PhotoAI is not intended for children under the age required by applicable law to use online services without parental consent. Do not upload images of minors unless you have the legal right and consent to do so.

10. International Processing

Your information may be processed in countries other than where you live. We take reasonable steps to protect information in accordance with this Privacy Policy and applicable laws.

11. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the effective date and provide notice where required.
